Definitions

“Wild Seed School of Herbal Studies” is a sole proprietorship registered and solely owned by 0949535 BC Limited, a registered British Columbia company.

“Activity” includes but is not limited to, inter alia, participating in all electronic, phone or in-person courses, mentorships and/or coaching conducted by the Wild Seed School of Herbal Studies, ingesting, tasting, handling and testing herbs and herbal formulas, participation in hikes and harvesting of herbs, traveling to and from harvesting/hiking sites, processing herbal products and teas in a kitchen, pruning, cutting and processing herbs, blending herbal medicines, handling alcohol and other products used in preparing herbal products, operating equipment used to prepare herbal products, distilling tinctures, and any other activities that may occur at the Wild Seed School of Herbal Studies from time to time.

“Instructor” includes but is not limited to the permanent instructors of the Wild Seed School of Herbal Studies, including Jasmyn Vanessa Clift, Maryann Abbs and Kevin Kunzler, as well as any apprentices, teaching assistants, student teachers and guest faculty who may instruct classes from time to time.

Waiver

Participants are responsible for their own well being while attending the Activity.  It is also their responsibility to inform the instructor and their fellow participants if there is some contraindication to participation in Activity.

In consideration of being permitted to participate in Activity conducted by Jasmyn Clift, Maryann Abbs, Kevin Kunzler and any other instructor of the Wild Seed School of Herbal Studies, I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, discharge and covenant not to sue Jasmyn Vanessa Clift, The Wild Seed School of Herbal Studies, its instructors, employees, agents and shareholders from liability from any and all claims resulting in personal injury, accidents or illnesses (including death) and property loss arising from but not limited to, participation in Activity.

Assumption of Risks, Indemnification and Hold Harmless

Your participation in Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.  The specific risks vary from one activity to another, but the risks range from and include, but are not limited to:

1. minor injuries such as scratches, bruises, sprains and reactions to herbal remedies;
2. major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; to
3. catastrophic injuries including paralysis and death.

I have read the previous paragraphs and I know, understand, appreciate and accept that there are risks involved in the Activity offered by Wild Seed School of Herbal Studies.  I am voluntarily requesting a participate in Activity at the Wild Seed School of Herbal Studies and I expressly agree to assume the entire risk of any and all accidents or personal injury, including death which I might suffer during my participation in Activity.

I freely accept and fully assume all risks, damages and hazards and the possibility of personal injury, death, property damage and loss and thereby waive any and all claims which I might at any time have against the Wild Seed School of Herbal Studies, its instructors, employees, agents and shareholders in any manner whatsoever relating to my participation in the Activity offered by Wild Seed School of Herbal Studies, whether due to negligence on behalf of the instructors, employees, agents and shareholders of the Wild Seed School of Herbal Studies or not.

By checking the consent box below this waiver, the participants agree to INDEMNIFY AND HOLD the instructors, employees, agents and shareholders of the Wild Seed School of Herbal Studies HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including legal fees brought as a result of my involvement in Activity and to reimburse them for any such expense incurred.

Severability

The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the Province of British Columbia and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
